Warranty:
We do not warrant equipment manufactured by others, but will submit the manufacturer's warranty on request.
Duty and Tax:
Any tax or duty required by law on sales of articles contained herein shall be in addition to their sale price and will be the responsibility of the purchaser.
Claims:
We are not to be held responsible for delays, damage, or loss due to shortage of materials, strikes, lockouts, differences with employees, accidents, fires, explosions, delays in manufacture, transportation of materials, acts of God, embargoes, inability to ship, inability to insure against war risks, governmental action, or insurrection, or other causes beyond our control, whether the same as or different from the matters and things herein before specifically enumerated.
Cancellation Charges:
As a general rule, products which are stocked by a distributor or manufacturer can be cancelled prior to shipment at no cost to the purchaser. However, non-standard, engineered, or customized items that are cancelled by you generally will require a cancellation charge. It is understood that a proper cancellation claim will be honored by you on the basis of expenses, costs and liabilities accumulated and/or incurred prior to the time of receipt at our main office of written notice of cancellation and reasonable costs incurred thereafter plus an amount to cover the extra costs of handling, general and administrative expense, burden and profit.
Applicability of these Terms and Conditions to your Purchase Order:
The terms and conditions contained herein, shall apply even though there may be a conflict with the terms and conditions of the purchase order.
Return Policy:
Return policy is dictated by the equipment manufacturer or other supplier, there is almost always a restocking fee and customized or otherwise special equipment is non-returnable. Return policies for specific products will be made available on request.
Minimum Orders:
Some manufacturers require a minimum order amount and others do not. Most of the items contained in this catalog already meet these minimums. If we find that your order does not meet the requirement for a particular manufacturer, we will notify you prior to entering your order with the manufacturer.
Equipment Application:
Proper application of the equipment purchased is the responsibility of the purchaser. Please insure that the equipment is being applied in a manner that is suitable and safe for that equipment and for the purpose and duty cycle for which it is designed. If you require assistance with the application, please don't hesitate to ask.
Freight:
Unless specified otherwise, all shipments will be made freight collect.

Terms of Payment for New Accounts:
Cash with order, Mastercard, Visa, or Net 15 days with approved credit. Some items may also be shipped C.O.D. but there would be an additional charge. Do not email your account information, we will get this information from you when we confirm your order.
Terms of Payment for Open Accounts:
Mastercard, Visa, or Net 30 days with approved credit. Do not email your account information, we will get this information from you when we confirm your order.
Additional Terms and Past Due Accounts:
Our 30 day statement will charge interest on the past due portion of your account at a rate of 1.9% per month until paid in full, starting from the date of the original invoice. These charges will be prorated on a per day basis for partial months.
Terms of payment shall be affected in no way should the equipment be damaged or destroyed by fire, the elements, or otherwise.
Failure to Pay:
All equipment and materials shall remain the property of the seller or the manufacturer or other supplier regardless of its permanence to the structure until all invoices are paid in full. The equipment and materials may be removed from the premises upon failure to pay at our discretion. Removal of the equipment and materials shall in no way relieve the buyers obligation to pay for the equipment and materials less its salvage value, any erection fees and all costs incurred to remove the equipment and materials.
Delivery:
Delivery promises are based on present promises of our suppliers and/or average history of delivery by a certain manufacturer and are subject to review at time of order. Changes in materials or specifications may affect this schedule.
Time and Effect of Acceptance:
Ordering from this electronic catalog shall constitute acceptance of all the terms and conditions stated herein. All pricing and specifications are subject to review and acceptance at time of order.
Limit of Liability:
Whether attributable to contract, warranty, strict liability or otherwise, seller's responsibility for any claims, damages, losses or liabilities arising out of or related to its performance of this contract or the equipment covered hereunder, including but not limited to any correction of the equipment defects
under the warranty or any applicable guarantees, shall not exceed the aggregate seller's selling price. In no event shall seller be liable for any special, indirect, incidental, consequential, or punitive damages of any character, including, but not limited to, loss of use of productive facilities or equipment, lost profits, property damages, personal injuries or lost production, whether suffered by the buyer or any third party, irrespective of whether claims or actions for such damages are based upon contract, warranty, negligence, equipment application, strict liability or otherwise.
